Statement on Judicial Independence and the Rule of Law

The Tamil Bar Association (TBA) is concerned by Premier Doug Ford’s continued public comments attacking Ontario’s judiciary and questioning the principle of judicial independence.

An independent judiciary is a fundamental pillar of Canada’s democratic system. Courts play a vital role in interpreting and applying the law, resolving disputes fairly, and ensuring that governments, institutions, and individuals remain accountable to legal and constitutional principles. Public confidence in the administration of justice depends upon the understanding that judges are free to decide cases based on the law and the evidence before them, without political pressure or interference.

Reasonable people may disagree with judicial decisions. Governments have the right to appeal rulings and pursue lawful policy responses within the framework of the Constitution. These are ordinary features of a healthy democracy. What is concerning, however, are repeated public attacks that diminish confidence in the judiciary as an institution or portray judges as obstacles to political objectives rather than independent decision-makers carrying out their constitutional responsibilities.

For many members of the Tamil Canadian community, the importance of independent institutions is not an abstract principle. Many have experienced, directly or through family history, the consequences of weakened democratic institutions and the absence of meaningful checks on state power. The erosion of public confidence in the administration of justice can have profound consequences, particularly for communities that rely upon independent courts to protect their rights and ensure accountability.

Independent courts are often the last line of protection for individuals and communities seeking fairness in the face of unequal power. Whether addressing constitutional rights, discrimination, government decision-making, or access to justice, courts serve an essential role in ensuring that legal rights are meaningful and enforceable. That role can only be fulfilled where judges are free to decide cases without fear of retaliation, political influence, or public pressure.

The strength of a democracy is reflected not only in its elected institutions but also in its commitment to preserving the independence and integrity of the institutions that safeguard the rule of law. Public officials bear a responsibility to engage in discussions about the justice system in a manner that respects these principles and maintains public confidence in the courts.

The TBA joins legal organizations and members of the legal profession across Ontario in reaffirming the importance of judicial independence, the rule of law, and respect for the constitutional institutions that underpin Canadian democracy. These principles are essential to protecting rights, ensuring accountability, and maintaining a justice system that serves all people equally.
